These Terms of Service (referred to as "Terms") govern your use of the mobile applications, platform and services (collectively referred to as the "Services") offered by JuzShop (defined below).
1. General
These Terms shall apply to all users of the Services provided by JuzShop, including without limitation, to users who are sellers, buyers, merchants, or contributors of content, information and other materials. If you are entering this agreement on behalf of a business entity, "you" in this agreement shall refers to the business entity unless the context suggests otherwise.
These Terms are between you and JuzShop or between you and the specific service provider identified for the service you are transacting with.
By using the Services in any purpose intended, you agree to abide by these Terms, as well as any additional terms, conditions, and policies referenced herein, in the platform or available via hyperlink.
JuzShop reserves the right to change or modify these Terms at any time. Your continued use of the Services after the amended Terms are posted here will constitute your agreement to the changes.
2. Use of the Services
Subject to your adherence to these Terms, JuzShop provides you with a limited, non-exclusive, revocable (with or without cause), non-transferable right and license to use the Services.
JuzShop reserves the right to reclaim any cashbacks, prizes, and/or amounts paid to you under any event, promotion, offers, campaign, or other activities. JuzShop also reserves the right to terminate or suspend your account if you are found or suspected to be engaged in any activity or act that breaches these Terms, our guidelines, any additional terms and conditions, or policies.
You shall use the Services in accordance with the following Terms and are prohibited from:
• Uploading or communicating any content that violates or infringes upon another party's rights of publicity, privacy, copyright, trademark, or any other intellectual property right.
• Modifying, interfering, or disrupting the integrity or performance of the Services.
• Violating any applicable laws, rules, or regulations in connection with your access or use of the Services.
• Using the Services in violation of any sanctions or embargo.
• Removing, altering, or obscuring any proprietary notice, such as copyright and trademark, belonging to JuzShop, partners, suppliers, or licensors.
• Using the Services for any purpose other than its designed or intended use.
• Using the Services to create or promote a product, service, or business model that directly or indirectly competes with those offered by JuzShop.
• Use the Services to send, post, or otherwise communicate any content which is offensive, including but not limited to falsehood, offensive, indecent, threatening, abusive, insulting, harassing, defamatory nature.
• Use the Services to engage in unsolicited or unauthorised communication and advertising related matters.
• Using the service to upload or transmit or redirects a virus.
• Using any automated device or means to access and monitor any portion of the Services and its data or content.
• Collecting any information regarding other users without their consent.
• Engage in any action to evade payment of any applicable fees and/or charges.
• Attempt to engage in any activities or acts that is intended to abuse or inappropriately manipulates the Services.
3. Account
To use the Services, you must have an account with JuzShop (referred to as "Account"). When creating an account, you represent and warrant the following:
• If you are an individual, you must be at least 18 years of age and of sound mind. If you are under 18 years of age, you may only use the Services with the consent of and under the supervision of your parent or legal guardian who shall be responsible for all your activities.
• If you are representing a legal entity (referred to as “Entity”), you have the authority to bind the Entity to these Terms.
• You are capable of entering into and performing legally binding contracts under applicable law.
• All information which you provide is accurate, up to date, truthful and complete.
• You are solely responsible for all activities and transactions under your Account. You are also required to keep your login credentials secured.
• Comply with all JuzShop prevailing policies and guidelines (which form a part of these Terms) and all applicable laws with respect to your activities and the content created.
• You agree not to create multiple accounts, lend, transfer or sell your Account or user ID to another party and must not use another user's Account without their permission. JuzShop reserves the right to suspend or terminate your Accounts, without advance notice to you for such non-compliance activities (e.g. engaged in a fraudulent or Prohibited Transaction using one of your multiple accounts)
4. Subscriptions, Fees and Payments
You may be charged subscription fees, listing fees, listing quota fees (collectively referred to as the "Fees") for the use of certain Services.
You may claim, redeem and/or purchase JuzShop’s subscriptions for access and use of additional features and Services. This shall be bounded by the standard terms of use. All subscription purchases will be subjected to the prevailing subscription rules and fees .
You may pay your JuzShop Fees using a credit card, debit card, cheque or by way of telegraphic or other electronic means of transfer.
You acknowledge and agree that:
• For recurring payment, you shall ensure that all due payments can be successful deducted from your bank. In the event of an unsuccessful payment, JuzShop reserves the right to immediately cancel, suspend or terminate any subscription until payment is received.
• Prompt notification of your credit card expiry with at least 14 days before your next subscription fee payment is due.
• No refunds of any unused subscription fees in the event that your Account is suspended or terminated due to a breach of these Terms,
• You shall make prompt payment of all JuzShop Fees, in full before the due date in accordance with our payment instructions. Any late payment or non-payment of amounts due to JuzShop shall grants us, without prejudice to any other rights or remedies to: (i) terminate and/or suspend your Account and/or your access to the Services; and/or (ii) claim back overdue payment fee on the with an interest rate of 1% per month, or maximum rate allowed by applicable law. You shall be responsible to pay the fess including the overdue Fees, legal fees and collection costs incurred by JuzShop in collecting the due amounts.
• Where your Account is suspended or terminated for any reason on any amounts due on your Account, JuzShop reserves the right to immediately charge any disputed amounts and entitled to terminate your Account, without prejudice to any other rights or remedies available to us; and
• You are responsible for all tax matters associated with using and making sales through the JuzShop Services.
• Additional fees may be charged for using the Services. Any applicable transaction fees will be disclosed to you before any charges are incurred.
5. Listing Quota
You may be limited to a maximum number of active listings you may publish on your Account. Any additional listing quota is subjected to further subscription with a fee in accordance with JuzShop’s prevailing fees’ rules and charges. You may purchase additional listing quota to increase the amount of listings on your account.
You acknowledge and agree that:
• JuzShop does not warrant that listing quota upgrades will lead to better business result intended.
• The consumption rate and expiry date set out in your Account shall serve as conclusive evidence of the consumption and expiry date of your listing quota.
• JuzShop reserves the right to correct the balance of your listing quota if we believe that an error has occurred.
• All fees and/or charges paid by you to us for any listing quotas upgrade are non-refundable.
• There will be no refunds in the event that your Account is suspended or terminated due to a breach of these Terms; and/or content not in accordance with these Terms.
• Listing quota after upgrades will be subjected to the prevailing listing rules.
• No refunds will be issued for unused listings.
• No refunds if your Account is suspended or terminated due to a breach of these Terms; and/or listing is not in accordance with prevailing Terms.
6. JuzShop as a Platform
JuzShop provides a platform for users to interact with each other and does not carry out pre-screening of listing and its content, JuzShop does not control or is liable on the following arising matters from listing’s content:
• The legality or authenticity of any aspect of the items advertised and/or listed.
• The quality, specification and accuracy of the listing.
• The true identity of a user.
• Any inappropriate content posted by users.
You are strongly encouraged to exercise good judgement when communicating with the user before committing to a transaction and making any payment. While JuzShop endeavours to keep the platform safe and low risk, your interaction with other users is entirely at your own risk.
7. Listing Content
The Services allow the users to create, post and share listing using contents that may include text, visuals, links, production information (referred to as “Contents”).
You shall be the rightful ownership of the Contents of the listing created in the platform but you grant JuzShop the right to use it for the purpose of furthering the platform development and operating needs, subject to JuzShop Privacy Policy terms.
You acknowledge and agree that:
• You are responsible for the Contents which you post or share on the platform.
• JuzShop reserves the right and in its sole discretion to refuse, delete or move any Contents posted. JuzShop shall have the right to block or remove Contents, without liability or the obligation to offer a refund in any of the following events:
• Contents is suspected has breached or believed to have breached the Terms.
• Received complaint or notice of infringement in respect relating to the Contents.
8. Transacting in JuzShop
In using the Services to create listings, you agree to comply with the following:
• All items must comply with the Terms of Use and all policies. Please reach out to admin@Juzshop should you need any help.
• The listing policy is applicable to all categories.
• You must provide complete and accurate information and description of each listing. No misleading information is allowed and will be subject to further action if found or reported. Setup information requirements for each category of listing must be complied.
• All listing must be listed in the appropriate category. All listing must comply with all applicable laws and regulations.
• All Singapore employment related listing must adhere to Ministry of Manpower of Singapore including the Tripartite Guidelines on Fair Employment Practices and the Tripartite Guidelines on Non-Discriminatory Job Advertisements (as may be amended or updated).
• Any links provided in the listing must not be directed to any illegal sites (including and not limited to pornography, gambling).
• All property listings must comply with all applicable laws, regulations and guidelines issued by Council for Estate Agencies ("CEA"), which includes the Practice Guidelines on Ethical Advertising and the Code of Ethics & Professional Client Care. It is an offence for any individual to carry out estate agency work without a valid registration.
• You acknowledge and agree that JuzShop shall not in any event be responsible or held liable for website, expired listing where JuzShop has no control over.
• Your item listed is not a stolen item, not counterfeit and does not infringe copyright, patent, trademark, trade secret or other proprietary or intellectual property rights.
• The sale of the item complies with all laws and regulations which apply to that item.
• Item listed is not dangerous, hazardous or subject to a recall by a government or manufacturer.
• Listing does not infringe or violate any applicable laws and regulations.
• All transactions accepted through the Services are binding on the transacting parties.
You acknowledge and agree that:
• As a seller who concludes a sales using cart out, you agree to process and ship the sale item(s) in prompt manner, unless due to exceptional circumstances. You may charge a reasonable shipping and handling charges to cover the delivery cost but must not over charge excessively or change the transaction price after sales, one sided.
• As a buyer who has completed a purchase using cart out, you agree to make prompt payment to the seller for the item purchased, expect for exceptional circumstance and/or agreed between the transacting parties.
• In communicating with a user through the Services for any purchase or sale of an item, you may obtain personal and contact information of that users solely for the purpose of the transaction. The transaction involved only the transacting parties and JuzShop cannot guarantee a complete transaction for any parties.
• If you are a user outside Singapore, you must that you comply with all the laws and regulations applicable for any purchase and sales using the Services. JuzShop shall not be liable for any offence you committed without due diligence or overlook on you part.
9. Counterfeit
JuzShop respects and acknowledges the intellectual property rights of originators. We take a firm stance against counterfeit products and will not tolerate any form of infringement on intellectual property rights. We are committed to maintaining the integrity of our platform and ensuring a safe and authentic shopping experience for our users.
Counterfeit products pose a serious threat to consumer safety and trust. JuzShop is committed to combating this issue and will take all necessary actions to protect the integrity of the Services and the rights of intellectual property owners. We appreciate the cooperation of our sellers and users in helping us maintain a safe and authentic shopping environment.
9.1 Detection and Reporting
JuzShop employs measures to detect counterfeit products listed on our platform. If we have reason to believe that a product is counterfeit, we will promptly remove the listing and investigate the matter further.
9.2 Action Against Sellers
Sellers are responsible for ensuring that all products listed on JuzShop are genuine and do not infringe on any intellectual property rights. Sellers should also take proactive measures to verify the authenticity of their products before
listing them.
Any seller found to be selling counterfeit products knowingly will face immediate and severe consequences. This may include but is not limited to:
• Forced removal of the listing.
• Temporary to permanent banning of the seller from the Services.
• Reporting the seller to relevant authorities for further investigation and legal action.
• Sharing information with third parties whose intellectual property rights have been infringed for their own action.
9.3 Reporting Counterfeit Products
If you believe that a product listed on the platform is counterfeit or someone has infringed your intellectual property rights on JuzShop, please report it to us immediately (admin@juzshop.com). We take all reports seriously and will investigate each case thoroughly. Your assistance in maintaining the authenticity of our platform is greatly appreciated.
9.4 Goods Considered Counterfeit, Fake, or Replica
Fake, replica, or counterfeit goods are designed to closely resemble an authentic product but are unauthorized copies. These products are typically produced and sold without the consent of the originator or brand owner with the aim to deceive consumers into believing they are purchasing the genuine product. Counterfeit goods can encompass a wide range of products, including clothing, accessories, electronics, pharmaceuticals, and luxury goods.
10. Payment Service
10.1 Payment Methods
JuzShop offers three payment methods for purchases and sales of listed items using its services, facilitating the payment options.
• QR Code Method: Users can scan a QR code to pay for goods or services. To prevent erroneous payments, users are required to upload their QR code and indicate the Payee Name.
• Bank Transfer Method: Users can transfer funds electronically from one bank account to another. Basic bank account information is necessary for setup.
• Fast Transfer Method: An instant funds transfer service, with PayNow being the primary method recommended. Other fast transfer methods, such as Paylah and Paypal, are possible but users are advised to exercise prudence.
For more information on PayNow, visit https://www.abs.org.sg/consumer-banking/pay-now. When making fast transfer payments, users should ensure the payee name matches the intended recipient, and the payment amount matches the purchase amount. PayNow and Paylah! payments are instantly transferred, and users should not believe in any "Scheduled PayNow/Paylah!" requests. No payments should be made on behalf of JuzShop.
10.2 Refunds and Returns
Refunds and return matters for completed and paid transactions must be resolved through discussion between the transacting parties.
10.3 Notification of Payment Disputes
If you believe any user or transaction has resulted in a scam situation, notify admin@Juzshop.com immediately. Upon receipt, an investigation will be conducted, which may take up to 3 working days. The user involved may have their account disabled during the investigation. Parties are responsible for resolving payment disputes, and a police report may be required due to the seriousness of the matter.
10.4 Payment Services Provider
You acknowledge that JuzShop may integrate the payment services provided by Payment Service Provider into the Service. You will be subjected to the additional terms stipulated by the payment service provider and agree to comply with such additional terms, including any modification or updated from time to time.
You acknowledge and agree that:
• You must provide accurate and complete payment information, required for using the respective payment services within the Services. The Privacy Policy shall govern the use of the information.
• You are legally authorized to provide the payment service information and authorize payment transactions to be performed on the Account setup. You are responsible for ensuring compliance with applicable laws and the payment service provider's terms of use while using the payment services.
• Payment service provider may use 3rd party service to process the payments and manage the account information you have provided. You can maintain, modify and delete payment account information within the Services.
• By using a particular payment method, you agree to the terms of service payment service provide and You (seller or buyer or both parties) will bear all fees that may be charged.
10.5 Alertness to Payment Scams
Protect yourself from fraud by identifying and avoiding scams and phishing attempts. Always verify the recipient's information before making a payment. Avoid sending money in exchange for claims on lottery or prize winnings, to unknown or unverified recipients, and in response to emails asking for account and personal information. JuzShop will never ask you to confirm your account and personal information via email.
11. Shipping Service
JuzShop does not have control over the delivery of items, including delivery fees and methods, specified by sellers, or agreed upon by transacting parties. JuzShop is not responsible for delays, delivery failures, damages, or losses resulting from shipping services.
11.1 Shipping Responsibility
Sellers are responsible for all shipping matters related to their sold items. This includes selecting the shipping carrier, securely packaging items, and ensuring timely delivery to buyers. Sellers should indicate the shipping fees and charge only the applicable delivery fees agreed upon by the transacting parties or chosen by the buyer.
Buyers must provide accurate information, including address and contact details, to avoid shipping issues. It is recommended that buyers use tracked or registered delivery services to prevent delivery problems. Sellers must provide valid proof of delivery and tracking information for tracked deliveries to facilitate verification and address validation.
11.2 Shipping Options
Transacting parties must agree on shipping options before completing a transaction. This includes the shipping carrier, shipping method (e.g., standard, expedited), and any additional services (e.g., tracking, insurance) desired.
11.3 Shipping Disputes
Disputes regarding shipping, such as delays, lost packages, or damaged items, shall be settled directly between the transacting parties. JuzShop does not intervene in shipping disputes but encourages open communication to resolve issues promptly.
11.4 Shipping Service Providers
You acknowledge that JuzShop may integrate the shipping services provided by certain service providers (referred to as “Shipping Service Providers”). The Shipping Service Providers may have its own respective additional terms and policies to adhere to. You must agree to comply with such additional terms and policies, which may be updated from time to time.
You acknowledge and agree that:
• You may update your delivery information directly through the Services but the updates will not be applicable for orders processed before delivery information are updated.
• You are legally authorised to provide the required shipping information and agreeing the terms of service of the shipping service provider.
• Unless otherwise agreed between the buyer and the seller, the buyer will bear all shipping related fees charged by Shipping Service Provider based on the selected delivery method. The shipping fees are charged per order unless special arrangement was agreed between transacted parties.
